Terms of service

These terms govern your use of QScope, a subscription service for running the commercial side of a construction contract: valuations, payment applications and certificates, variations, retention and the final account. By opening an account you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind it.

1. What QScope does, and what it does not do

QScope helps you record valuations, produce payment applications, certificates and notices, track variations and retention, and calculate the statutory payment dates that follow from a due date under the Housing Grants, Construction and Regeneration Act 1996 and the contract form you select.

QScope is a tool, not a surveyor and not an adviser. It performs calculations from the figures, dates and contract form you enter. It does not check whether those inputs are correct, whether the contract form you selected is the one that actually applies, or whether a valuation is professionally justified. Every figure, notice and certificate you issue remains your own professional work and your own professional responsibility. QScope does not provide legal advice, contractual advice or a professional opinion of any kind.

You are responsible for reviewing every document before you issue it, and for complying with your own professional obligations, including any RICS rules of conduct and professional indemnity requirements that apply to you.

2. Your account

  • You must give accurate registration details and keep them up to date.
  • Each person who signs in must have their own user account. Shared logins defeat the audit trail, which records who prepared and changed each document.
  • You are responsible for everything done under your account, and for keeping passwords confidential.
  • Tell us promptly at help@qscope.co.uk if you believe an account has been compromised.

Clients, subcontractors and other project participants you invite as guests are not counted against your plan and do not need their own subscription.

3. Trial

New accounts get a free trial. No card is required to start it. When the trial ends, the account becomes read-only: your data stays intact and you can still view and export everything, but you cannot make changes until you choose a plan.

4. Subscription, billing and renewal

  • Plans are priced by the number of users who can sign in and by the number of active projects the plan covers. Both figures are shown on the pricing page. Archived projects do not count towards the project figure. Prices exclude VAT unless stated otherwise.
  • Payments are taken by Stripe. Card details are entered on Stripe's own pages and are never stored by QScope.
  • Subscriptions renew automatically at the end of each billing period, monthly or annually, until cancelled.
  • You can change plan, update your payment method, download invoices and cancel at any time from your account, without contacting us.

Price changes

We may change prices. If we do, we will give you at least 30 days' notice by email before the change applies to your subscription, and the change will take effect from your next renewal. If you do not accept a price change, you can cancel before it takes effect.

Cancellation and refunds

Cancelling stops the next renewal. Your subscription runs to the end of the period you have already paid for, and you keep full access until then. We do not give partial refunds for unused time, except where the law requires it or where we have failed to provide the service.

5. Your data

  • You own your data. Projects, valuations, certificates, drawings, photographs and documents you put into QScope remain yours.
  • We store your data separately from other customers' data and use it only to provide and support the service.
  • You can export your data at any time while your account exists, including after a trial ends.
  • If you cancel, your data remains available for export for 60 days. After that we may delete it. Ask us before then if you need longer.

Personal data is handled as described in our privacy policy.

6. Acceptable use

Do not use QScope to break the law, infringe anyone's rights, or upload malware. Do not attempt to gain access to other customers' data, to probe or disrupt the service, or to resell access to it without our written agreement.

We may suspend an account that puts the service or other customers at risk. Where it is reasonable to do so, we will tell you first and give you a chance to put things right.

7. Availability

We work to keep QScope available and to protect your data, but we do not promise uninterrupted service. Maintenance, hosting failures and problems at third parties can all cause downtime. We do not offer a contractual uptime guarantee on the plans listed on the pricing page.

Because statutory payment deadlines have real consequences, do not rely on QScope as your only record of a deadline. Keep your own diary of critical dates.

8. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, and because QScope is a low-cost tool rather than a professional service:

  • We are not liable for loss of profit, loss of contract, loss of anticipated saving, loss of goodwill, or any indirect or consequential loss.
  • We are not liable for the consequences of figures, dates or documents you produce using QScope. Checking them is your professional responsibility, as set out in section 1.
  • Our total liability to you in any 12-month period is limited to the amount you paid us for QScope in that period.

You should carry your own professional indemnity insurance appropriate to the work you do. QScope is not a substitute for it.

9. Ending the agreement

You can stop using QScope and cancel at any time. We may end the agreement on 30 days' notice, or immediately if you seriously breach these terms. If we end it without cause, we will refund the unused part of any period you have paid for.

10. Changes to these terms

We may update these terms. If a change materially affects your rights, we will give you at least 30 days' notice by email. Continuing to use QScope after that means you accept the updated terms.

11. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
